Terms of Use
These Terms of Use (hereinafter "the Terms") govern the use of the Fixoo.be platform, published by Mashaah LLC. By accessing the platform or creating an account, you accept these Terms without reservation.
Purpose
The purpose of these Terms is to define the terms and conditions of use of the Fixoo.be platform (hereinafter "the platform"), as well as the rights and obligations of the parties when using it.
Fixoo.be is a matchmaking platform connecting clients (individuals, businesses, property managers, landlords) with building and home service professionals in Belgium.
Definitions
- Platform: the Fixoo.be website and its associated features
- Client: any natural or legal person using the platform to find a professional
- Professional: any natural or legal person registered on the platform and offering services
- User: collectively refers to both clients and professionals
- Service request: any request for a service submitted by a client via the platform
- Publisher: Mashaah LLC, the company operating the platform
Access to the platform
Access to the platform is free for clients. Browsing professional profiles and submitting service requests does not require an account, although one is recommended for optimal tracking.
Registration as a professional requires creating an account and accepting the specific professional conditions, available on the Professional conditions page.
Access to the platform may be temporarily suspended for maintenance, updates, or any technical reason. The publisher endeavours to minimise the duration of such interruptions.
Use of the platform
The user agrees to use the platform in accordance with its intended purpose and in compliance with these Terms and applicable legislation.
The following are expressly prohibited:
- Any use of the platform for illegal, fraudulent, or harmful purposes
- Creating accounts under a false identity or with false information
- Spam, unsolicited solicitation, or sending abusive communications
- Attempting to access other users' data without authorisation
- Mass reproduction or extraction of data from the platform
- Using robots, scrapers, or other automated means without authorisation
User account
Creating an account requires providing accurate, complete, and up-to-date information. The user is responsible for the confidentiality of their login credentials and for all activities carried out from their account.
The user agrees to notify the publisher immediately of any unauthorised use of their account or any security breach.
The publisher reserves the right to suspend or delete an account in the event of non-compliance with these Terms.
Service requests
The client can submit a service request by describing their needs (type of service, location, urgency, problem description). This request is then made available to matching professionals on the request marketplace.
The client agrees to provide accurate and complete information when submitting their request. Any false declaration or abusive request may result in account suspension.
Client-professional relationship
Fixoo is not a party to the contract concluded between the client and the professional.
The platform facilitates matchmaking but does not intervene in the negotiation, conclusion, or execution of the contract between the client and the professional. The service contract is concluded directly between these two parties.
The professional is solely responsible for the quality, compliance, and timeliness of their services. The client is solely responsible for paying for the services agreed directly with the professional.
Fixoo's liability
Fixoo acts as a technical matchmaking service provider. The platform does not select, mandate, or employ the listed professionals.
The publisher cannot be held liable for:
- Work carried out by professionals and its quality
- Execution delays or non-execution of services
- Disputes arising between clients and professionals
- The accuracy of information published by users
- Service interruptions or technical bugs
- Indirect damages resulting from the use of the platform
Moderation and disputes
The publisher implements a professional verification system to enhance trust on the platform. However, this verification does not constitute a guarantee of service quality.
In the event of a dispute between a client and a professional, the parties are encouraged to seek an amicable solution. The publisher may, at its discretion, offer a mediation service without this constituting an obligation.
The publisher reserves the right to suspend or delete the account of any user whose behaviour is contrary to these Terms or to the law.
Pricing and payment
Access to the platform and submitting service requests are free for clients.
Professionals have a subscription with a trial period, followed by paid plans. Current pricing is available on the Pricing page. Payment is processed via Stripe, a secure payment provider.
The price of services performed by professionals is agreed directly between the client and the professional, independently of the platform.
Intellectual property
All elements of the platform (brand, logo, design, texts, source code) are the exclusive property of Mashaah LLC or are used under licence. Any reproduction without prior written authorisation is prohibited.
Information published by users (profiles, reviews, photos) remains their property. By publishing it on the platform, the user grants the publisher a non-exclusive licence to use it for the operation of the platform.
Duration and termination
These Terms apply for the entire duration of the user's use of the platform.
The user may delete their account at any time from their personal space or by contacting the publisher.
The publisher reserves the right to terminate or suspend access to the platform in the event of a breach of these Terms, without prejudice to any damages that may be claimed.
Changes to the Terms
The publisher reserves the right to modify these Terms at any time. The modifications take effect upon publication on the platform. Users are encouraged to review the Terms regularly.
In the event of a substantial change, the publisher will inform registered users by email where possible.
Governing law
These Terms are governed by Belgian law. In the event of a dispute, the parties shall endeavour to resolve it amicably. Failing an amicable agreement, the Belgian courts shall have sole jurisdiction.
